RICHMOND, VA – Today, the Youngkin Administration issued an official Attorney General opinion declaring Virginia will not participate in Advanced Clean Cars II (ACCII) despite the standards being adopted and twice reaffirmed by the Virginia General Assembly. Federal law allows for states to adopt either the EPA standards or standards that are even cleaner, with the latter mandating greater protections and aggressively reducing tailpipe pollution that degrades our climate and harms public health, especially in environmental justice communities. If upheld the decision will restrict Virginians’ choice because auto manufacturers prioritize delivery of EVs to states that have adopted ACCII.

In response, Connor Kish, Director of the Sierra Club Virginia Chapter, issued this statement:

“This latest attack on clean car standards is further proof that Governor Youngkin thinks he can sidestep the laws he doesn’t like. Advanced Clean Car Standards boost our economy, increase market choice, and save lives. Virginians deserve a Governor who prioritizes their health and future. The people of Virginia and our democratic processes are not Gov. Youngkin’s hedge fund.”
