On Monday November 2, 2020, Sierra Club Managing Attorney Sanjay Narayan will appear before the U.S. Supreme Court, arguing on our behalf in the case U.S. Fish and Wildlife Service v. Sierra Club, No. 19-547. Briefly, the case involves whether the Fish and Wildlife Service may refuse to turn over documents to Sierra Club under the Freedom of Information Act.
The documents are biological opinions in which the Services concluded that a rule proposed by EPA for the intake of cooling water from power plants and industrial facilities would impermissibly affect threatened and endangered species. The Services have refused to release the opinions to the public, characterizing them as "drafts." We cheer on Sanjay as he makes the best case possible for more transparency under FOIA.
