Washington, DC — La administración Biden dio hoy varios pasos para deshacer los debilitamientos del gobierno previo de la Ley de Especies en Peligro. El Servicio Federal de Pesca y Vida Silvestre (USFWS) y la Agencia Nacional de los Océanos y la Atmósfera (NOAA) empezarían, entre otros, los siguientes procesos:
- Rescindir regulaciones que revisaron el proceso del USFWS de considerar exclusiones en la designación de hábitats cruciales. Esto eliminaría cambios de la administración Trump que otorgaron a la industria indebida influencia en la evaluación oficial de beneficios para designar un área como hábitat crucial.
- Rescindir la definición regulatoria de hábitat. Eliminaría la regla de la administración Trump que definía ilegalmente el término “hábitat” para excluir localizaciones de las protecciones de la Ley de Especies en Peligro, incluso si se convirtieran en hábitat en el futuro, o pudieran ser restauradas para convertirlas en hábitats apropiados.
- Revisar regulaciones para catalogar especies y la designación de hábitat crucial. Acabaría con el intento ilegal de la administración Trump de permitir consideraciones económicas para influenciar inapropiadamente el proceso de designación.

“Nos complace grandemente que la administración Biden esté restaurando y aplicando debidamente las protecciones de la Ley de Especies en Peligro, una de las herramientas más eficaces para detener la crisis de extinción. La administración debe corregir todos los cambios ilegales de la administración Trump, y hacerlo con premura.
“La Ley de Especies en Peligro goza de abrumador apoyo y es efectiva para detener la extinción del 99% de las especies. La administración Trump intentó socavar su eficacia haciendo más difícil para las agencias federales catalogar especies, proteger hábitat y actuar para detener las extinciones.
“Ahora, la administración Biden tiene que avanzar hacia la total eliminación de los ataques del gobierno previo contra esta ley fundamental. Así hacerlo nos acercará a las soluciones sustentables y justas necesarias para detener la crisis climática, y reducir la extinción masiva, y los daños a los terrenos, agua y hábitat públicos”.

Sierra Club Celebrates Biden Administration Move to Reinstate Protections in Endangered Species Act
Washington, DC— Today, the Biden administration took several actions to undo the previous administration’s gutting of the Endangered Species Act. The U.S. Fish and Wildlife Service and NOAA announced the agencies would begin the process to:
- Rescind regulations that revised Fish and Wildlife Service’s process for considering exclusions from critical habitat designations: This would scrap changes by the Trump administration that gave industry undue influence over USFWS’ weighing of the benefits of designating an area as critical habitat.
- Rescind regulatory definition of habitat: Would scrap the Trump administration rule that unlawfully defined the term “habitat” to exclude locations from Endangered Species Act protections even if they will become habitat in the future, or could be restored to become suitable habitat.
- Revise regulations for listing species and designating critical habitat: Would undo the Trump administration’s unlawful attempt to allow economic considerations to improperly influence listing decisions.

“We are thrilled the Biden administration is moving in the direction of reinstating and fully enforcing protections under the Endangered Species Act— one of our most effective tools in slowing the extinction crisis. We need the administration to correct all of the unlawful changes made under the Trump administration, and to do so urgently.
“The Endangered Species Act is overwhelmingly supported and effective— stopping 99% of species listed from going extinct. The Trump administration attempted to undermine its efficacy by making it harder for federal agencies to list species, protect habitat, and take the action necessary to slow extinction.
“Right now, the Biden administration must move to completely undo the attacks on this bedrock law carried out under Trump. Doing so will move us closer to the sustainable and just solutions necessary to stop the climate crisis, slow mass extinction, and damage to our public lands, water and habitat.”
