SAN FRANCISCO — The Ninth Circuit Court of Appeals today ruled that President Trump’s attempt to circumvent Congress and transfer of $2.5 billion in military pay and pension funds for border wall construction is unlawful. The court also forcefully rejected the administration’s argument that no one can go to court to block the president’s blatant abuse of power. The court affirmed the district court’s order blocking the illegal construction.

The Sierra Club filed a motion for preliminary injunction in its lawsuit against the Permian Highway Pipeline. In late April, the Sierra Club filed a lawsuit arguing that the Army Corps failed to comply with the National Environmental Policy Act (NEPA) when it approved the project without first conducting the required analysis of environmental impacts, providing for public participation, or considering alternative routes.

LITTLE ROCK, AR -- In a victory for Arkansas clean energy consumers, today the Public Service Commission (PSC) ruled that solar power generated by users and returned to the grid shall be credited by utilities at a fair price that encourages the growth of the solar industry in our state. A 2019 bipartisan solar law required the PSC to determine how to credit residential customers for the value of solar energy generated by home solar systems that flows back to the electric grid.

Washington, DC -- Today, southern Oregon organizations filed a lawsuit challenging Federal Energy Regulatory Commission (FERC) approval of the Jordan Cove LNG export terminal and Pacific Connector fracked gas pipeline. FERC issued its approval in March, conditioned on the project qualifying for critical permits from the state of Oregon. Three of those permits have already been denied or withdrawn.

Oakland, Calif. — Today, over two years after Judge Vince Chhabria struck down the City of Oakland’s prohibition on handling and storage of coal at the former Oakland Army Base, the case was decided on appeal by three Ninth Circuit judges. The judges heard oral arguments on the appeal by the City of Oakland, Sierra Club, and San Francisco Baykeeper in November 2019. The judges decided to uphold the previous decision, overturning the City of Oakland’s prohibition on handling and storage of coal.
