Court weighs Chapter’s suit against Indian Point

On May 3, the oral arguments relating to Indian Point were heard before the three judges at the 2nd Circuit Court of Appeals in Lower Manhattan.

The Atlantic Chapter is a co-plaintiff in this lawsuit challenging a secret decision by the Nuclear Regulatory Commission, to permit the substandard insulation on the electric cables that control the shutdown of the nuclear plant during an emergency. Entergy, owner of Indian Point, had been granted this exemption without a public hearing. The judges repeatedly asked the U.S. attorney the rationale for not allowing a hearing. The exemption had been granted four days after its application.


Former assemblyman and attorney Richard Brodsky argued very well on our behalf. He is also a co-plaintiff. Ulrich Witte is our expert witness and has provided technical advice.
